205 – Family Medical Leave Act (FMLA)

I. Purpose

The purpose of the Family Medical Leave Act (FMLA) is to allow those in need, to care for family, and or themselves in a qualifying event. The law does not allow the use of family leave for intermittent care of commonplace illnesses, such as colds or the flu.

II. Policy

FMLA allows eligible employees (male and female) to take up to 12 weeks of leave during any 12 month period for the birth of a child, an award of adoption or foster care of a child, or to care for a spouse, child, parent, or self in a qualifying event.

III. Procedure

A. Application forms for FMLA will be maintained and supplied to employees by Human Resource Division (HR).

B. Adequate written notice (30 days), except in the case of an emergency, must be provided. Such written notice must stipulate the effective dates of the family leave.

C. Questions regarding FMLA should be directed to HR.

D. All FMLA requests will be administered in accordance with Harris County personnel regulations.
